Terms of Use (End User Licence Agreement)
Contents
1.Scope
These terms form an agreement between you and OWNER_LEGAL_NAME, OWNER_POSTAL_ADDRESS (“we”, “us”) for the use of the Valiro mobile app, its optional encrypted cloud backup and the website at 194-238-26-76.sslip.io (together, the “Service”). By installing or using the app you accept these terms. If you do not accept them, please do not use the app. The app is not intended for children under 16.
2.Licence
The app is licensed to you, not sold. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices that you own or control, for your own non-commercial purposes, in line with these terms and the rules of the store you downloaded it from. You may log data for another person, for example a family member you care for, if you are entitled to do so.
3.Not medical advice
Valiro is a personal logbook and is not a medical device. It does not measure, diagnose, treat, cure or prevent any condition and gives no medical advice. Always talk to your doctor about your readings and before making medical decisions. Please read the Medical disclaimer, which is part of these terms.
4.Your data and the recovery code
Your entries belong to you. They are stored on your device. How we handle personal data is described in the Privacy Policy.
If you turn on the optional cloud backup, the app creates a recovery code and shows it to you once. The code is the only way to restore or delete the backup. We do not receive it, we cannot see it and we cannot recover it. If you lose the code, the backup cannot be restored. Keep the code safe and do not share it: anyone who has it can read and delete your backup. You are responsible for keeping your own copies of data that matter to you, for example with the free export and backup file functions.
5.Premium and subscriptions
Valiro is free to use. Optional paid features are called “Premium”. Premium is offered as an auto-renewing monthly subscription, an auto-renewing yearly subscription and, where available, a one-time lifetime purchase. The current features, prices and billing periods are shown in the app on the purchase screen before you buy, in your local currency. Prices may vary by country and may include taxes.
- Payment. Payment is charged to your Apple Account (iOS) or Google Account (Android) when you confirm the purchase. We do not receive your payment details.
- Automatic renewal. Monthly and yearly subscriptions renew automatically for the same period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Free trial. The yearly plan includes a 7-day free trial for new subscribers where the store offers it. If you do not cancel at least 24 hours before the trial ends, the subscription starts and the price shown is charged. Any unused part of a free trial is forfeited when you buy a subscription, where applicable.
- Managing and cancelling. You manage and cancel subscriptions in your store account settings, not in the app and not with us. On iOS: Settings → your name → Subscriptions. On Android: Google Play → profile icon → Payments & subscriptions → Subscriptions. Step-by-step links are on our Support page. Deleting the app does not cancel a subscription. After cancelling, Premium stays active until the end of the period you have paid for.
- Refunds. Apple and Google process payments, so refund requests go to them under their rules: Apple at support.apple.com/118223, Google at support.google.com/googleplay/answer/2479637. We cannot refund payments ourselves. Statutory rights that you have as a consumer, including any right of withdrawal, are not affected.
- Price changes. If a price changes, the store informs you and, where required, asks for your consent before the new price applies.
- Lifetime purchase. A one-time purchase unlocks Premium on your store account for as long as we offer Premium in the app.
- Restore and platforms. You can restore purchases in the app. Purchases are tied to your store account and do not transfer between iOS and Android.
- When Premium ends. Your entries stay on your device and the free features keep working. You can always download and delete an existing cloud backup. Uploading new backups requires Premium.
6.Acceptable use
Do not misuse the Service. In particular, do not try to access other people’s backups or accounts, to break or bypass security or rate limits, to overload the servers, to reverse-engineer the app except as permitted by law, or to use the Service for unlawful purposes.
7.Intellectual property
The app, its design, texts and code belong to us or our licensors and are protected by law. Your entries and the reports you create remain yours.
8.Availability and changes
We work to keep the Service available but cannot guarantee uninterrupted operation. We may update, change or discontinue features. If we discontinue the cloud backup, we will give reasonable notice in the app and on this website so that you can download your backup. Where a change significantly affects something you have paid for, we will offer a fair solution.
9.Warranty and liability
Your statutory rights as a consumer, including legal warranty rights for defective digital content, remain unaffected.
We are fully liable for intent and gross negligence, for injury to life, body or health, under mandatory product liability law, for fraud, and for anything else that cannot be limited by law. In case of slight negligence, we are liable only for breach of an essential obligation, meaning one whose fulfilment makes proper performance of the agreement possible and on which you can regularly rely, and then only for foreseeable damage typical for this kind of agreement.
Subject to the above and to the extent permitted by law, the free features are provided “as is” and our total liability for claims relating to the Service is limited to the amount you paid for Premium in the 12 months before the event that caused the claim. This limit does not apply where the law does not allow it, and it does not limit your statutory consumer rights or any refund or other remedy you are entitled to under Apple’s or Google’s refund policies or section 13. We are not responsible for decisions you take based on the content of the app or its reports, or for data lost because a recovery code or device was lost, unless we caused the loss through a fault for which we are liable under this section.
10.Termination
You can stop using the app at any time and delete your data in the app, and your cloud backup in the app or on our website. We may suspend or end your access if you seriously or repeatedly breach these terms, after warning you where reasonable. Sections that by their nature should continue to apply do so after termination.
11.Changes to these terms
We may change these terms for good reasons, such as new features or legal requirements. We will tell you in the app or on this website before a material change takes effect. If you do not agree, you can stop using the app. Your continued use after the effective date means you accept the new terms to the extent the law allows.
12.Governing law
These terms are governed by OWNER_GOVERNING_LAW. If you are a consumer, this does not take away the protection of the mandatory consumer provisions of the country where you live, and you may bring claims in the courts of that country.
13.Apple and Google
This section applies if you downloaded the app from the Apple App Store. It is required by Apple and prevails over other parts of these terms in case of conflict.
- Acknowledgement. These terms are between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the app and its content.
- Scope of licence. The licence is limited to a non-transferable licence to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms.
- Maintenance and support. We, not Apple, are solely responsible for maintenance and support. Apple has no obligation to provide them.
- Warranty. If the app fails to conform to a warranty that applies, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Other claims, losses, liabilities, damages, costs or expenses due to non-conformity are our responsibility.
- Product claims. We, not Apple, are responsible for any claims relating to the app or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection, privacy or similar claims.
- Intellectual property claims. If a third party claims that the app infringes its intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of the claim.
- Legal compliance. You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on a US Government list of prohibited or restricted parties.
- Developer contact. OWNER_LEGAL_NAME, OWNER_POSTAL_ADDRESS, OWNER_SUPPORT_EMAIL.
- Third-party terms. You must comply with applicable third-party terms, for example your wireless data agreement, when using the app.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, have the right to enforce them against you.
If you downloaded the app from Google Play, the Google Play Terms of Service apply to your purchase, and Google is not a party to these terms and not responsible for the app.
